1. Acceptance of Terms
By accessing or using ShipyardPro ("the Platform"), operated by PT. Automata Info Nusantara ("the Company"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
ShipyardPro is a cloud-based shipyard management platform providing tools for project management, financial operations, HSE compliance, asset maintenance (CMMS), procurement, workforce management, and logistics. The Platform is offered as a subscription-based Software-as-a-Service (SaaS).
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. Each user account is for individual use only — sharing credentials is prohibited.
4. Subscription & Payment
- Subscriptions are billed monthly or annually as selected during sign-up
- All fees are non-refundable except as required by law or as specified in our refund policy
- We reserve the right to adjust pricing with 30 days advance notice
- Failure to pay may result in service suspension
5. Data Ownership
Your data belongs to you. All operational data entered into ShipyardPro — including project records, financial data, vessel information, and uploaded documents — remains the sole property of your organization. We act as a data processor on your behalf. You grant us a limited license to process your data solely for the purpose of providing and improving the service.
6. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable regulations
- Attempt to gain unauthorized access to other users' accounts or our infrastructure
- Upload malicious code, viruses, or any content that could harm the Platform
- Reverse engineer, decompile, or attempt to extract the source code of the Platform
- Resell, sublicense, or redistribute access to the Platform without written consent
- Use automated tools to scrape, crawl, or data-mine the Platform
7. Service Level Agreement (SLA)
We commit to 99.9% uptime for enterprise accounts. Scheduled maintenance windows will be communicated at least 48 hours in advance. In the event of SLA breaches, eligible customers may request service credits as outlined in their enterprise agreement.
8. Intellectual Property
The Platform, including its design, code, features, documentation, and branding, is owned by PT. Automata Info Nusantara and protected by intellectual property laws. Nothing in these Terms grants you ownership of any part of the Platform.
9. Limitation of Liability
To the maximum extent permitted by law, ShipyardPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the event giving rise to the claim.
10. Termination
Either party may terminate the subscription with 30 days written notice. Upon termination, you may request a data export within 90 days. After 90 days, all data will be permanently deleted. We reserve the right to immediately terminate accounts that violate these Terms.
11. Governing Law
These Terms shall be governed by the laws of the Republic of Indonesia. Any disputes arising from these Terms shall be resolved through arbitration in Jakarta, Indonesia, in accordance with the rules of the Indonesian National Board of Arbitration (BANI).
